Agreement
By scheduling service, signing a contract, or using this website, you agree to these terms. Long Island Cesspool Co. ("we," "us," or "Contractor") provides cesspool, septic, grease trap, and related sanitary services in Suffolk County and eastern Nassau County, New York.
Scope of work
Scope is defined per job in a written estimate or service agreement. Work outside the written scope requires a change order signed by the customer before additional work begins. Verbal modifications are not binding.
What's included in every job:
- Labor and standard materials listed in the estimate
- Equipment (trucks, excavators, pumps) and fuel
- Disposal fees for waste hauled to licensed transfer stations
- Standard backfill and rough grading of excavated areas
- Permit fees where applicable (itemized separately)
What's not included unless specifically listed:
- Premium landscape restoration (sod, plantings, pavers, masonry)
- Driveway or concrete repair
- Interior plumbing beyond the house trap
- Removal of obstructions we did not install (trees, sheds, fences)
- Engineered designs or soil testing beyond standard SCDHS submittal
Pricing and payment
Estimates: Written estimates are valid for 30 days. After 30 days, pricing may be re-quoted to reflect current material and disposal costs.
Deposits: Replacement and installation jobs typically require a 25% deposit at contract signing to reserve crew and order materials. Deposit is credited against the final invoice.
Progress payments: On larger jobs, progress payments are due at defined milestones (permit issued, excavation complete, installation complete, final inspection).
Final payment: Due within 10 days of final inspection pass unless financing terms specify otherwise.
Accepted payment: Check, ACH, credit card (3% processing fee on cards), financing through Synchrony or GreenSky, and SCSIP grant direct-pay.
Late payment: Invoices unpaid after 30 days accrue 1.5% monthly interest. Accounts over 60 days may be sent to collections or secured by mechanic's lien per New York Lien Law.
Warranties
Workmanship: 2-year warranty on all labor and installation work. Covers defects in installation, not damage from misuse, overloading, chemical abuse, or third-party tampering.
Tank warranty: Manufacturer warranty applies. Concrete tanks typically 5-10 years manufacturer, plastic/fiberglass typically 10-25 years. We pass through manufacturer warranty.
I/A system warranty: Manufacturer warranty varies (typically 2-5 years mechanical, longer on structural components). Required maintenance contract keeps warranty in force.
Pumping service: We guarantee the tank is pumped to the level stated on the receipt. We do not warrant the overall condition of the tank or field based on a pumping visit.
Not covered:
- Damage from tree roots infiltrating lines after installation
- Damage from flushing non-biodegradables (wipes, feminine products, grease)
- Damage from commercial-grade water volume on a residential system
- Acts of God (floods, earthquakes, hurricanes)
Customer responsibilities
Customer agrees to:
- Provide accurate information about the property, system location, and known issues
- Grant access to the property for scheduled work
- Mark private utilities not covered by 811 (invisible fence, sprinkler lines, private low-voltage)
- Pay invoices according to agreed terms
- Follow I/A maintenance schedule if applicable
- Notify us of any post-installation issues within the warranty period
Permits and compliance
We pull SCDHS, town, and state permits as required. Customer is responsible for:
- Disclosing known easements, setbacks, or restrictions
- Providing survey or property boundary information when requested
- HOA or covenant approvals if applicable (we don't handle these)
All work complies with SCDHS Article 6, relevant town codes, and New York State Sanitary Code. Customer-requested deviations from code are not permitted.
Unforeseen conditions
Underground work sometimes reveals conditions not visible at estimation: buried debris, rock, high water table, abandoned systems, contaminated soil, undocumented utilities. If we encounter unforeseen conditions, we stop work, photograph the condition, and present a written change order before proceeding. You can approve, modify, or decline. If you decline, we backfill to safe condition and bill for work completed to that point.
Cancellation
Customer cancellation:
- Before deposit: no charge
- After deposit, before work starts: deposit refunded less administrative/permit costs actually incurred
- After work starts: customer pays for work completed plus material costs, minus deposit
Contractor cancellation: We may cancel a job if unsafe conditions, non-payment, or material customer misrepresentation is discovered. In that event, customer is liable for work completed.
Liability
Our liability is limited to the cost of the service provided. We carry general liability insurance ($2M per occurrence) and workers' comp as required by New York law. Certificate available on request.
We are not liable for:
- Pre-existing conditions unrelated to our work
- Damage to unmarked private utilities
- Consequential damages (lost income, hotel stays, etc.) beyond what our insurance covers
- Delays caused by permit office, weather, or material supply chain disruptions
Disputes
Good-faith effort first: we ask customers to contact Tom directly (tom@longislandcesspools.com) with any concerns before escalating. We'll try to resolve in person or by phone.
If unresolved, disputes are governed by New York law and subject to the jurisdiction of Suffolk County courts. Small claims preferred for amounts under jurisdictional limits. Arbitration available by mutual agreement.
